The General Conditions of Contract and Use presented, apply to all visitors from the site www.girosworld.com and any and all transactions of a commercial nature made through the website Giros World, from now on called only Giros.

Both the website navigation and order placement regarding any product available in the online store implies the full acceptance of these General Terms and Conditions of Contract and Use by the user and/or customer.

Giros reserves the right to change these Conditions of Contract and Use without notice, being the subsequent changes published at www.girosworld.com, respecting the principles set out by the RGPD.

 

2. Content, Certified Property and Responsibilities

www.girosworld.com is intended for private and dedicated use of the company only. Reproduction, transfer, distribution or storage of its content without prior permission is prohibited for purposes other than strictly personal and non-profit use.

Giros reserves itself the right to modify, at any time, the information and commercial offer presented regarding products, prices, promotions, business conditions, appearance and other services.

We are not responsible for any typographical and web programming error. Nevertheless, we work every day in order to minimize them. Images and graphics presented are for illustrative purposes only. Colors and proportions may differ from the actual product. It is recommend, in all cases, the consultation of the technical description of each product. Prices, accessory information, product details and specifications are subject to change without further notice. Prices, stocks, contents and illustrations presented in www.ajaguiar.com are independent from those presented in any physical space or other order placement platforms. Giros is responsible for submitting all information and expressions associated with the content marketed. However, content authorship is responsibility of the manufacturers of the products concerned. Giros is not liable for any error of translation nor is it responsible for the content presentation.

All images, illustrations, videos and texts displayed in www.girosworld.com are reserved under copyright and intellectual property on a global level. Any use of this content, whether or not for profit, is strictly prohibited without prior authorization.

Giros® is a registered trademark of the company AJ Aguiar, Lda. and authorized for electronic marketing of various products through this channel. On the website www.girosworld.com, in addition to Giros products, products of various brands and licenses can also be found whose liability for the reproduction of their distinctive signs is also protected under the legal provisions applicable to intellectual property. Any and all commercial registration is ensured by the commercial relationship with the company AJ Aguiar, Lda., owner of the trademark rights through its Database and other computer mechanisms.

Products marketed in Giros are in accordance with Portuguese and European legislation and strictly meet EU standards pursuant to Directive 2009/48/EC. Giros is not liable for any violations of the law in countries where the goods can be delivered. It is up to the customer to check the import conditions for the products he wishes to order.

Giros is not liable for any viruses or cyber-attacks that may damage the structure and content of the website and/or cause any interruption in its presentation.

 

3. Associated domains ownership

All domains and subdomains registered in www.girosworld.com are respectively owned by the brand and are duly approved by the "Regulation for .PT domain/subdomain registration" and the legal deposit No. 238398/06. The brand Giros® also holds the registration of other associated fields: www.girosshop.pt and www.giros-shop.pt.

 

4. Customer's and User's obligations

Users and the Customers must comply with the hereby presented general conditions and abide by them. Furthermore, both user and customer must fulfill the following obligations:

1) It is forbidden to enter, store or distribute obscene, defamatory, libelous, xenophobic and/or any other kind of content that violates the general principles of the law and public order through the website;

2) Do not disclose login credentials, such as your password, in order to prevent others from accessing your account in Giros;

3) Do not use false identities. Your account in www.girosworld.com is personal and not transferable;

4) To provide personal data and correct addresses (Zip Code completed in full) so that Giros can properly process and deliver orders;

5) Customer and / or User must agree to the General Terms and Conditions to register on the page and / or to promote a particular purchase;

The customer is responsible for the accuracy of the data reported on www.girosworld.com and undertakes to promptly enter any changes into their Giros Online Registration Account.

Giros is not responsible for any delay or incapability to process an order, particularly in the delivery act, caused by data wrongfully and/or insufficiently provided by the customer.

Giros reserves itself the right to delete an account whose holder do not complies with the above-mentioned obligations.

 

5. Orders, Payment and Delivery

For making purchases and/or orders through the site www.girosworld.com, the user should register as a customer by completing the available online form, or, alternatively, make the purchase as a guest, providing only the data necessary for the shipment/billing of the items. Registered or not, the user can add all items to the virtual shopping basket available and follow the necessary steps until the completion of the purchase/order. You will be duly notified if your purchase is successfully registered in the Giros database. If the user makes a purchase without customer registration, Giros is only in possession of user data to dispatch / invoice the respective purchased items.

Prices and stocks charged at the online store www.girosworld.com are completely independent of the commercial policy of Giros physical shops. The promotions presented always follow an order of their own rounding, to the nearest decimal place.

Giros reserves the right to authorize external partners to mediate payments received, either by credit card or PayPal, in compliance with all established legal forms.

Orders are processed after confirmation of the payment. The availability of articles may vary depending on the processing. The estimated period for the articles delivery varies from 12 to 48 hours in mainland Portugal, from 2 to 15 working days in the Azores and Madeira Islands, depending on the method chosen. The estimated time does not include the time spent by the carrier on the processing of the goods. In any case, the estimated delivery dates are merely indicative. Giros is not responsible for delays caused by the incorrect provision of data by the customer. Other types of delays and contingencies do not entitle the customer to compensation.

NOTE: Under normal conditions, the delivery of the goods in mainland Portugal is estimated on the day following the payment of the order upon its confirmation order by 3:30 PM. For payments made after 3:30 PM we are unable to guarantee next day delivery. We are not responsible for deliveries to countries not properly listed in the above mentioned price list.

The accepted payment methods are: ATM, MB Way, PayPal, VISA and Mastercard. If the customer is interested in making a payment using another method, such as a bank transfer, they should make the appropriate request through spv@girosworld.com

 

6. After Sales Service and General Terms and Conditions of Warranty

Giros has its own After Sales Service (SPV) department that guarantees the customer the best possible treatment of any and all issues associated with any return, exchange or repair processes. This service may be requested by the customer at any time via email to spv@girosworld.com

Prices and stocks at www.girosworld.com are absolutely independent of the commercial policy of Giros physical stores. Existing promotional campaigns at www.girosworld.com are for online marketing only and limited to existing stock. In the event of a break in stock after payment has been made for a particular item, the customer will be contacted and given the opportunity to have the amount paid for the product refunded. Giros reserves the right to cancel the delivery of a particular product where an error has been detected while processing at the time of purchase. Giros complies with all rules regarding any promotion on the website. Each article page that is in promotion/price reduction is duly indicated with its discount, price before and after the discount was applied, the start and end date of the respective promotional period. Some items with promotion and/or price reduction may be discontinued and, accordingly, the price reduction end date may be extended until the stock of the article runs out.

Any return, claim or exchange of articles must be communicated by email: spv@girosworld.com. Giros, after receiving the complaint process, must issue a response within 3 working days in which the RMA case number will be mentioned. The document generated must be printed by the customer and must be attached to the goods to be returned. Giros will never accept in its logistics department any article that does not meet these prior communication requirements. Items returned beyond the RMA number must be accompanied by a copy of the proof of payment (Article 6 of DL 143/2001 of 26 April, as amended by DL 82/2008 of 20 May). 

The process of return, exchange or repair is governed by the basic principles set forth in Decree-Law No. 84/2008 - Article 9. According to the referred Decree Law, the general consumer benefits from two types of Warranty: General Compliance Guarantee without costs and Voluntary Guarantee of Assistance with costs.

Legal Warranty of Compliance WITHOUT costs of replacement, repair and other charges. This consumer benefit is strictly applicable to any article with obvious production or assembly defect, non-conformity that compromises the perfect functioning of the article and is therefore detectable at the initial use, avoiding the aggravation of the damage. The exercise of this right requires that the article be returned in perfect condition, in new packaging, without scratches or obvious cuts. Under these conditions the article is presumed to be DOA (Dead on Arrival), that is, a damaged item from the beginning or from the moment of purchase;

Voluntary Service Warranty WITH costs within or outside the Legal Warranty period, which will allow any item to be repaired through budgeting, whenever the Service Center determines that the malfunction is caused by misuse, heavy wear of parts, shock, violent fall or breakage of parts that has compromised the perfect functioning of the article. This budget repair will be communicated to the customer and will only be effective upon customer acceptance.

In compliance with the law, Giros allows all its customers to exchange or return items purchased in the online store, within 14 days from the date of the purchase operation and provided that this is properly communicated. The return or exchange of articles in this period and provided for in these conditions implies the return of the articles in a state of non-use, good condition as received, complete original packaging and in good condition and accompanied by proof of payment. Returns are not accepted for items that involve customization by the customer or hygiene and beauty articles. If the detected problem is prefigured in the DOA regime, Giros will schedule the picking of the article in question at no cost to the customer. The items to be returned must be properly packed and sent to Customer Service and Support Center | Rua Comendador Sílvio, 450 | 4535-032 Lourosa | Portugal. In either case, the articles must always be sent to their respective addresses and this is the responsibility of the customer. All items will be checked upon arrival at our service and will only be accepted for exchange or return those that comply with the return conditions set forth herein and / or duly informed when sending the RMA to the customer. Returns will only be made after checking the condition of the product. Failure to comply with the points set out in the Compliance Legal Warranty at no charge will automatically be taken to the Voluntary Assistance Guarantee Scheme, in which case the customer may be liable to pay additional fees.

Giros also provides a Technical Assistance Center dedicated to the repair or exchange of any claims for proceedings under the General Compliance Guarantee within 2 years after the date of purchase under Decree Law No. 84/2008 - Article 9 . All products are covered by this two year general warranty of compliance. This consumer benefit is strictly applicable to any article with obvious production or assembly defect, non-conformity that compromises the perfect functioning of the article and is therefore detectable at the initial use, avoiding the aggravation of the damage. The return of articles is always the responsibility of the customer and must be sent to Customer Service and Support Center | Rua Comendador Sílvio, 450 | 4535-032 Lourosa | Portugal. Once the article has been received at these facilities, a technical report will be made to verify the compliance of the complaint. If any non-compliance is found, the item will be repaired or replaced with a new one at no cost to the customer. If it is not possible to repair or exchange a new one, the customer will be reimbursed for the same amount as the purchase. If signs of misuse are detected and / or any external problem that may have caused its malfunction (such as fall or humidity) the customer will be contacted to authorize the process to transition to the Voluntary Assistance Guarantee scheme. costs. Any repair process that gives rise to budgeting will only be finalized upon authorization by the customer for repair. The beginning of the repair by the Technical Assistance Center implies the receipt of the payment stipulated in the budget.

Items not covered by the general compliance timeframe may also be submitted for repair and/or technical assistance upon budget. Repair will only commence upon acceptance of payment by the customer.

If the return process gives rise to a refund of the amount paid, the same payment method used at the time of payment will be used. In case of impossibility, an IBAN will be requested through which the amount due can be refunded.

The absence of a prolonged response, for a period longer than 30 days, in the case of the budgeting of a particular process may necessarily lead to the destruction of the articles or their donation to a charity. Open RMA processes whose goods are not entered into our facilities within a maximum of 30 days will be automatically completed without further return.

In accordance with the terms of article 4 of Decree-Law no. 24/2014, of 14 February, Giros reserves to the consumer the free and spontaneous right to terminate the purchase agreement established on the website, in a maximum period of 14 days and no need to state the reason.

 

7. Terms of the Guarantee Right's Loss

The loss of the warranty right will occur:

- If it is found by the Service Center that the defect was caused by misuse or in disagreement with the instruction manual.

- The product is connected to a power source other than those recommended in the manufacturer's instruction manual accompanying the product.

- The defect is caused by nature agents or accidents whose liability is not motivated by the manufacturer and / or distributor.

- The warranty seal, seals, or other product identifiers are removed, covered, or tampered with.

- In case the proof of purchase is not presented by the customer.

- If the article is not in a good state of repair, for example broken parts, torn lead wires, fall-deformed components, loss of parts and other components, or other patent damage to articles or their accessories that indicate poor use or any random incident.

- The provision of a Warranty Service does not require free replacement of parts or components. Any of these components may be replaced at no cost to the Customer should the Customer Service Center find that this is a production defect, this being its sole responsibility.

 

8. Discount and/or Promotion Policy

Giros complies with all current regulations regarding promotions and or price reductions promoted by the website, namely with regard to Decree-Law No. 70/2007, of 26 March and the amendments to which it was submitted by Decree-Law No. 10/2015. Each article page that is in promotion/price reduction is duly indicated with its discount, price before and after the discount was applied, the start and end date of the respective promotional period. Some items with promotion and/or price reduction may be discontinued and, accordingly, the price reduction end date may be extended until the stock of the article runs out.

 

9. Privacy and Personal Data Protection (RGPD)

Protecting the privacy and personal data of all the people who in any way relate to Giros/AJ Aguiar, Lda. is a fundamental commitment of our company. We work daily to ensure the best levels of protection of privacy and personal data while respecting the law and all applicable national and European standards and guidelines for their processing. This commitment is embodied in privacy policies and standards, including the Customer Privacy Policy, the Employee Privacy Policy, and the General Information Security Policy. In this regard, in addition to complying with the legal obligations set out in Law 67/98 of 26 October, we have adjusted our personal data management policy to the new General Data Protection Regulation resulting from Directive (EU) 2016/680 of the European Parliament and of the Council of 27 April 2016.

 

General Terms for Privacy and Personal Data Protection

1. Personal data shall be any information of any kind whatsoever on any medium (eg sound or image) relating to an identified or identifiable person. An identifiable person shall be deemed to be identifiable directly or indirectly, for example by the name, identification number, biometric data, an electronic identifier or other elements enabling the identification of that person.

At Giros we are aware of the legal distinction made between Personal Data and Sensitive Personal Data. We mean by Personal Data all those that identify the person as a member of a community group, such as name, address, IP address, mobile number. Sensitive Personal Data means all data that identifies the person as a human being and through which a violation can directly affect your fundamental rights as a citizen, such as ethnicity, voice, social background, political and philosophical beliefs. At Giros we do not store or collect any sensitive personal data.

2. Holders of personal data are considered to be entities (companies and/or individuals), customers, suppliers, employees and commission sellers who voluntarily and explicitly provide their personal data to Giros and with which Giros has a business and/or employment relationship established and defined by the terms of the law.

3. The entity in charge of the processing of personal data is Giros. Giros is responsible for the processing, protection and respect of the rights of the respective personal data.

5. Personal data of commission entities, employees and/or sellers may be collected without the conclusion of a formal commercial contract.

6. The data collected are mandatory for Giros to communicate with the respective entity. From the set of data collected, the following stand out as essential: name, alias, tax identification number (TIN), full address, telephone contacts, e-mail address, contact persons, bank details, online access user to digital platform www.girosworld.com, original registration creation password, educational background, registration creation date, date of birth. The omission or inaccuracy of the data is the responsibility of the data subject who accepts the terms of its use.

7. The scope of use of the data aims to a) send correspondence to the given addresses, b) send relevant commercial news and notifications via e-mail address, c) telephone contact, d) consultation of information by employees within the company staff identified through tiered access in the ERP, e) treatment for marketing and sales campaigns, f) management and monitoring of the entity, g) provision of a service, h) use of information as a source of integration of computer systems and / or other outsourced services, (i) reporting of data to their competent tax authorities, (j) accounting, tax and administrative management, (k) litigation management, (l) auditing and consulting, (m) network and system management n) control of information security and physical security, o) control of attendance and punctuality.

8. Treatment for marketing purposes is carried out in accordance with the prior, free, specific and unambiguous consent expressed. Consent may be expressed by written declaration or by validating an option. The data subject may object at any time to the processing of data for marketing purposes by the means indicated in point 9 (4).

9. Giros may use subcontractors for the processing of personal data, such as lawyers, accounting and consulting firms, computer integration services, banks and insurers. These subcontracting entities are defined and registered for consultation and are required to develop appropriate technical and organizational data protection measures ensuring the rights of the holder. In certain circumstances defined by law, certain personal data may need to be disclosed to public authorities, such as the tax authority, courts and security forces.

10. Personal data are retained for different periods of time. Uncontested data presupposes its storage indefinitely. Personal data is stored in a secure digital database and / or a physical archive under the RGPD.

11. The data subject is always guaranteed the right of access, rectification, opposition, deletion, limitation and portability thereof. The exercise of these rights may be manifested by the means indicated in point 9 (4).

12. Without prejudice to the possibility of complaint to Giros, the data subject may submit a complaint directly to the competent supervisory authority.

14. The data subject always has the option to exercise his or her self-regulatory power in this regulation, and may, at any time, report and formalize any complaint against Giros with the National Data Protection Commission (CNPD) justifying the respective non-compliance.
