Privacy and Personal Data Protection (RGPD)

Protecting the privacy and personal data of all the people who in any way relate to Giros/AJ Aguiar, Lda. is a fundamental commitment of our company. We work daily to ensure the best levels of protection of privacy and personal data while respecting the law and all applicable national and European standards and guidelines for their processing. This commitment is embodied in privacy policies and standards, including the Customer Privacy Policy, the Employee Privacy Policy, and the General Information Security Policy. In this regard, in addition to complying with the legal obligations set out in Law 67/98 of 26 October, we have adjusted our personal data management policy to the new General Data Protection Regulation resulting from Directive (EU) 2016/680 of the European Parliament and of the Council of 27 April 2016.

 

General Terms for Privacy and Personal Data Protection

1. Personal data shall be any information of any kind whatsoever on any medium (eg sound or image) relating to an identified or identifiable person. An identifiable person shall be deemed to be identifiable directly or indirectly, for example by the name, identification number, biometric data, an electronic identifier or other elements enabling the identification of that person.

At Giros we are aware of the legal distinction made between Personal Data and Sensitive Personal Data. We mean by Personal Data all those that identify the person as a member of a community group, such as name, address, IP address, mobile number. Sensitive Personal Data means all data that identifies the person as a human being and through which a violation can directly affect your fundamental rights as a citizen, such as ethnicity, voice, social background, political and philosophical beliefs. At Giros we do not store or collect any sensitive personal data.

2. Holders of personal data are considered to be entities (companies and/or individuals), customers, suppliers, employees and commission sellers who voluntarily and explicitly provide their personal data to Giros and with which Giros has a business and/or employment relationship established and defined by the terms of the law.

3. The entity in charge of the processing of personal data is Giros. Giros is responsible for the processing, protection and respect of the rights of the respective personal data.

5. Personal data of commission entities, employees and/or sellers may be collected without the conclusion of a formal commercial contract.

6. The data collected are mandatory for Giros to communicate with the respective entity. From the set of data collected, the following stand out as essential: name, alias, tax identification number (TIN), full address, telephone contacts, e-mail address, contact persons, bank details, online access user to digital platform www.girosworld.com, original registration creation password, educational background, registration creation date, date of birth. The omission or inaccuracy of the data is the responsibility of the data subject who accepts the terms of its use.

7. The scope of use of the data aims to a) send correspondence to the given addresses, b) send relevant commercial news and notifications via e-mail address, c) telephone contact, d) consultation of information by employees within the company staff identified through tiered access in the ERP, e) treatment for marketing and sales campaigns, f) management and monitoring of the entity, g) provision of a service, h) use of information as a source of integration of computer systems and / or other outsourced services, (i) reporting of data to their competent tax authorities, (j) accounting, tax and administrative management, (k) litigation management, (l) auditing and consulting, (m) network and system management n) control of information security and physical security, o) control of attendance and punctuality.

8. Treatment for marketing purposes is carried out in accordance with the prior, free, specific and unambiguous consent expressed. Consent may be expressed by written declaration or by validating an option. The data subject may object at any time to the processing of data for marketing purposes by the means indicated in point 9 (4).

9. Giros may use subcontractors for the processing of personal data, such as lawyers, accounting and consulting firms, computer integration services, banks and insurers. These subcontracting entities are defined and registered for consultation and are required to develop appropriate technical and organizational data protection measures ensuring the rights of the holder. In certain circumstances defined by law, certain personal data may need to be disclosed to public authorities, such as the tax authority, courts and security forces.

10. Personal data are retained for different periods of time. Uncontested data presupposes its storage indefinitely. Personal data is stored in a secure digital database and / or a physical archive under the RGPD.

11. The data subject is always guaranteed the right of access, rectification, opposition, deletion, limitation and portability thereof. The exercise of these rights may be manifested by the means indicated in point 9 (4).

12. Without prejudice to the possibility of complaint to Giros, the data subject may submit a complaint directly to the competent supervisory authority.

14. The data subject always has the option to exercise his or her self-regulatory power in this regulation, and may, at any time, report and formalize any complaint against Giros with the National Data Protection Commission (CNPD) justifying the respective non-compliance.
